1. Acceptance

By accessing beer.tv or any page on it, you agree to these terms of use. If you do not agree, please do not use the site. These terms apply alongside our privacy policy, which forms part of them.

2. What this site is

Beer.TV is an informational website offering a single domain name, beer.tv, for sale by private agreement, together with a journal of market analysis. It is not a marketplace, an auction platform, a brokerage, an escrow service, or a financial services provider.

3. Offers are invitations to treat, not contracts

Nothing on this site constitutes a binding offer to sell. All content, including any description of the domain, its qualities or its potential, is an invitation for you to make an offer.

When you submit the offer form or email offers@beer.tv:

• You are making a non binding indication of interest, unless you expressly state otherwise in writing
• We are under no obligation to accept, counter, or respond to any particular offer, although we intend to acknowledge all genuine offers in writing within 24 hours
• No contract is formed until both parties sign a written purchase agreement covering the specific terms of the sale
• We may accept, reject or counter any offer for any lawful reason, or withdraw the domain from sale at any time

You confirm that any offer you submit is made in good faith, that you have authority to make it on behalf of any company you name, and that the information you provide is accurate.

4. Escrow and completion

Where a sale is agreed, the transaction will be completed through a licensed third party escrow service such as Escrow.com, or another service agreed in writing by both parties. That escrow service operates under its own terms, which will govern the handling of funds and the transfer mechanics. We are not a party to, and are not responsible for, the acts or omissions of any escrow service, registrar or payment provider.

Domain transfer timing is subject to the policies and technical processes of the relevant registrars and the .TV registry, which are outside our control.

5. No warranty on the asset beyond ownership

We represent that we hold the beer.tv domain name and have the right to transfer it, and that representation will be confirmed in any written purchase agreement. Beyond that, the domain is offered on an as is basis.

We make no representation or warranty regarding the suitability of the domain for any particular purpose, any level of traffic, search performance, advertising revenue, resale value or future appreciation, or the availability of any trademark, business name or corresponding domain in any other extension. You are responsible for your own due diligence, including any trademark or regulatory clearance relevant to your intended use.

6. Journal content is commentary, not advice

The journal publishes market commentary. Figures are drawn from third party sources that are named and linked in each article. Market research forecasts are modelled estimates produced by their publishers and are not audited results.

Nothing in the journal is investment advice, legal advice, tax advice, or a recommendation to buy, sell or hold any asset. We take reasonable care with accuracy but do not warrant that any third party figure is correct, current or complete. You should verify anything you intend to rely on, and every source is linked so that you can.

7. Intellectual property

All content on this site, including text, design, layout, code and graphics, is owned by Beer.TV or used with permission, and is protected by copyright and other intellectual property laws.

You may view, download and print pages for your own internal business evaluation of this opportunity. You may quote short extracts with clear attribution and a link to the source page. You may not republish substantial portions, use the content to train machine learning models, scrape the site systematically, or use it commercially without prior written permission.

Third party names, marks and figures referenced in the journal belong to their respective owners and are used for identification and factual reporting only. Their appearance does not imply any endorsement of, or affiliation with, Beer.TV.

8. Acceptable use

You agree not to use this site to submit false, fraudulent or bad faith offers, to impersonate any person or company, to transmit malware or attempt to gain unauthorised access to any system, to scrape or harvest data by automated means, to interfere with the operation or security of the site, or to use it for any unlawful purpose.

We may block access from any address that breaches this section.

9. External links

This site links to third party websites, primarily the sources cited in the journal. We do not control those sites and are not responsible for their content, accuracy or privacy practices. A link is a citation, not an endorsement.

10. Disclaimer

This site is provided on an as is and as available basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components.

11. Limitation of liability

To the fullest extent permitted by law, Beer.TV and its owner will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of this site or reliance on its content, whether based in contract, tort, statute or otherwise, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to this site and these terms will not exceed one hundred United States dollars (USD 100). Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation.

12. Indemnity

You agree to indemnify and hold harmless Beer.TV and its owner from any claim, liability, loss or expense, including reasonable legal fees, arising from your breach of these terms, your misuse of the site, or your violation of any law or third party right.

13. Age and responsible enjoyment

This site is intended for a business audience aged 18 or over. It concerns the sale of a domain name. It does not sell, market or promote alcoholic beverages, and no product is offered for purchase or consumption anywhere on it. Where alcohol is discussed, it is discussed as an industry. Please enjoy beer responsibly, and only if you are of legal drinking age in your jurisdiction, which is 21 and over in the United States.

14. Governing law and venue

These terms and any dispute or claim arising out of or in connection with them, this site, or their subject matter, whether contractual or non contractual, are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

You and Beer.TV agree that the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any such dispute or claim, and you consent to personal jurisdiction and venue in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Where mandatory consumer protection law in your country of residence gives you rights that cannot be excluded by agreement, those rights are unaffected by this section.

15. Severability and waiver

If any provision of these terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of our right to do so later.

16. Changes

We may update these terms from time to time. The version in force is the one published on this page, and the date at the top shows when it last changed. Continued use of the site after a change means you accept the updated terms. Any written purchase agreement signed by both parties overrides these terms to the extent of any conflict.

17. Entire agreement and contact

These terms and the privacy policy are the entire agreement between you and Beer.TV regarding use of this site, and supersede any prior understanding on that subject.
